Marriage Contracts

So you have decided to get married and you want to have an agreement prepared dealing with your respective rights and obligations. These rights and obligations may be matters within the marriage itself or matters that will only arise on separation, annulment of your marriage, divorce or even death. This type of an agreement is referred to as a Marriage Contract.

In a Marriage Contract, the spouses may deal with:

Ownership in or division of property
Support
Children’s education and moral training
Any other matter

Cohabitation Agreements

A Cohabitation Agreement is similar to a Marriage Contract. It is designed to accommodate the wishes of people who are living together, or intend to live together, but who will not marry. In it they may deal with the same subjects that may be dealt with in a Marriage Contract and they are subject to the same restrictions.

 

If the parties to a Cohabitation Agreement later marry each other, the agreement is deemed to be a Marriage Contract

Separation Agreements

A man and a woman – whether legally married or not, or same sex couple, who have cohabited may enter into an agreement once they are living separate and apart, and may agree to their respective rights and obligations, including, but not limited to:

Ownership in or division of property
Support
Ownership in or division of property
Support obligations

Right to direct the education and moral training of their children
Right to custody and access to their children
Any other matter in the settlement of their affairAny other matter
